The Hudson Formula: death by footnote

Contractors’ claims to recover lost head office overheads are typically large, contentious and difficult to defend. This talk reviews the troubled origins of the Hudson Formula and its demise, considers the consequences of this for tribunals and asks whether claims of this nature might soon by replaced by the NEC or FIDIC’s planned contractual provisions.  This talk is based on Dr Ronan Champion’s 1st prize winning entry to the SCL Hudson Prize competition 2020.
